Update to privacy notice for electoral registration in response to the COVID-19 outbreak

What is the legal basis for processing this data?

Under Article 5 GDPR: Principle (b) purpose limitation, we may use the personal data for another compatible purpose or where we have a clear obligation or function set out in law. Given the Coronavirus pandemic, there is substantial public interest in sharing such information pursuant to Articles 9 (2) (b) and 9 (2) (g) GDPR and paras 6, 11 and 16 of Schedule 1 of the DPA 2018.

Under the Civil Contingencies Act 2004 a Local Authority has a duty to assess, plan and advise and to performs its functions so far as necessary to reduce, control or mitigate its effects or take other action in connection with it, as well as to maintain arrangements to warn the public, and to provide information and advice to the public, if an emergency is likely to occur or has occurred. The council will be using the data on the above noted legal basis without seeking your prior consent.

Who will your information be shared with?

Lewisham’s Covid-19 Response Team who will use the data to contact people for Covid-19 related purposes

The relevant laws listed above allow us to share data and we will be using these in order to contact those identified as potentially vulnerable. Only the minimum information for the purpose will be shared.

We will normally only share your information as part of the response to the Covid-19 outbreak.

Information will not be shared for any other non-related purposes.

Any information which is shared will only be shared on a need to know basis, with appropriate individuals.

Your rights

You are entitled to request a copy of any information about you that we hold.

If you have reason to believe that the information we hold about you is inaccurate you have a right to have this corrected and you have the right to request completion of incomplete data.

You have the right to request that we stop, or restrict the processing of your personal data, in certain circumstances.

Where possible we will seek to comply with your request, but we may be required to hold or process information to perform our statutory functions.
