Protecting your tenancy deposit
Your landlord is usually required to place your deposit in one of the three official government-backed schemes:
You can check if your deposit is protected by visiting the relevant scheme's website and searching using your name and postcode.
Prescribed information
If your landlord uses an insurance-based scheme or one of the official three, they must provide you with what's called "prescribed information." This explains:
- the rules of the deposit scheme
- how to reclaim your deposit
- what to do in case of a dispute
If you haven't received this information and cannot find proof that your deposit is protected online, request written confirmation from your landlord detailing how the deposit has been safeguarded. Keep a copy of your request and any responses, as they may be needed if legal action becomes necessary.
If your landlord has withheld your deposit
Shelter offers a helpful online guide outlining the steps to take if your landlord won't return your deposit. If your deposit hasn't been properly protected, you can apply to your local County Court for:
- the return of your deposit
- compensation up to three times its value
